I have a client who is literally dying from the stress of litigation. Unsure
what to do. Advice, please.
The other party is represented by a crazy sole practitioner who is relentlessly
shredding my client with a superhuman level of work day and night, including an
endless stream of motion filings and other proceedings. I have five attorneys
in my law firm and we have not been able to keep up with the barrage of
communications and filings, nor can my client afford to do so. I received an
email from the client yesterday stating that he had been in and out of the
hospital for the last month, which is why I didn't hear from him. He indicated
that he has a heart condition, has little time left to live, and is under
doctor's orders to avoid all stress. Good luck with that here. What am I
supposed to do ethically if a client is going to die from the litigation? Any
suggestions would be greatly appreciated.

Can you appeal to the judge? Can you show opposing counsel is harassing? Even if
you lose the motion the judge may be more sympathetic

Is this for a divorce case? Bro talk about cruel and inhumane. Also, can't
collect child support if your ex is dead.

It's a divorce plus a small civil lawsuit that the ex-wife filed because she was
in a psychotic episode and gifted my client $15,000 along with giving him
flowers (crazy). She is a successful engineer at a major company and makes a
lot of money, while my client is retired, unable to work, and suffering until he
dies. Sad.

I am really sorry to hear about this man. Hope it gets resolved soon. I imagine
you have already tried speaking with the crazy sole practitioner who seems to
sort of be behaving as a hired gun. Can you request mediation at this point?
Maybe a mediator could really solve things. What is the timeline for requesting
mediation during divorce proceedings there?

You may also want to suggest your client go to the Mayo Clinic, even if he has
to self pay with taking out a loan, it may be worth it to save his life.
