I'm in a three-day custody trial and it's punishing to my health
We just had day one yesterday, and it was draining, yet I could barely sleep
last night. The opposing party's testimony was weak, and gave the air of
someone who was defeated. She didn't speak with any conviction or even
confidence. The co-parent counselor trashed my client and blamed him for there
not being a settlement over the holiday schedule. After my cross examination of
her, on the way out of the courtroom the bailiff told me "well played, sir."
Lol.
I tell people that trials are like a boxing match: you get some hits in, and
they get some hits in, and it's not over until the decision. Clients always
have high anxiety while trials are ongoing, so a big part of my job is the pep
talk where I try to calm them down. This one is interesting because it's very
civilized so far, and there is no domestic violence issue, unlike many prior
trials I have had in this field. This may even be the first actual custody
trial I have had outside a domestic violence context, which is surprising to me.
The DV trials are twice as stressful because they are so emotionally charged,
so I'm not exactly complaining. But having a three-day trial over where a six
year-old goes to school and what the parents' holiday schedule is seems a little
extreme.

Reply #10765732 We concluded day two yesterday,
and I was so wired that I again had trouble sleeping even though I was seriously
depleted. I feel like crap right now. This only happens in some trials. I
think it's the combination of pressure managing the law firm, along with all my
other cases, piling up during the trial and taking a lot out of me. It never
ends; I have a deposition this morning and a status conference this afternoon.
I'm looking forward to a relaxing weekend, after which I have to repeat this
process over the next few weeks.

got up at 5 a.m. this morning, and my brain is freaking fried. Need to relax
this weekend very badly. JDU dark mode is the perfect thing for me to do
instead of yet more legal work.
