The Justice Gap - what are your thoughts?

What do you think the reasons are? I think the bottom line is that it is not economical to serve the bottom 80% of clients because their legal problems are too
small, too simple, or too infrequent. It makes no sense for me to bring in a client who is going to have only a few hours of work per year and will not even
reach the retainer, because I get random phone calls and texts from them about tiny problems and it's just an added burden when I'm trying to focus on
litigated, profitable cases. We saw this problem in [redacted]'s case, where nothing important happened for over a year and the client was erratic and
unreliable. I even told her that her case was not intended to be on ice for this long and that I couldn't justify retaining her as a client without having work
to do on her case. She recently switched to a cheaper individual attorney, and I'm glad to be rid of that one.
Part of the status quo is the excellent client mix here: I'm happy with having successful individuals and small businesses as clients-- but that means that only
the top 20% of clients can afford the service here, because only that percentage of people can sustain a spend of $5,000 to $15,000 per month on attorney fees.
And it's important to have that large retainer of $15,000 per case be non-refundable, which seems to have filtered out tire-kickers in order to focus the firm
on clients who are serious, have legitimate claims, and actually want to proceed with their cases instead of keeping their options open.

We need more legal aid societies for.the poor and more lawyers in rural areas. Tribal legal licensing of the currently 150k plus (likely double) JD grads
without a law license fixes this issue. Also, law school needs to come down in cost because it's made it impossible for those wanting to practice in rural areas
to afford to do this. Who can practice in bumblefuck Nebraska after attending U Nebraska Law School for $150k in debt.

I had this fantasy of starting a small claims action mill
Because there are so so so many small injustices perpetrated by businesses etc especially against elderly
But these would be case maximum 5k to be split
So the end situation is what you say lawyers will not take the case
The whole law insurance thing is interesting but they merely give out advice I don't think they would take a case or would they
It's a well known fact that lawyers can be a weapon used by the wealthy against the poor or otherwise those with less resources
That can include time as well
My parents personally have two decent legal cases but I don't know how to file in court and don't have time
I think amongst the population many people have legal issues which do not attract any attention from lawyers

I think the case matters more than the client. For poor people, you would have to take the case on a contingency basis. The poor client can have a slum dunk
multimillion dollar case, so when you are a plaintiff's attorney it depends more on the defendant than your client. Does the defendant have deep pockets? If its
a poor client and poor defendant then it will not make sense to pursue the wrongdoer.
For example, rape is a terrible thing and battery is terrible, but lets face it, the woman raped or battered by the poor guy will get nothing if she pursues him
in a civil suit. Most firms will only take a case against a rich celebrity or against an institution (i.e. church or school or some big time employer). The poor
woman raped by the poor guy is not without recourse though. She can get justice through filing a police report and having the guy arrested. Maybe you cannot
take every case, but when possible, you can advise them to file a police report. Sadly, many of these pro bono clinics/legal aid societies do not even want to
take many cases. Offering unbundled legal services can be risky. Check the laws in your state.

Many firms that take clients with trivial matters become mills. Litigation is tedious and not worth it for attorneys unless slam dunk cases worth at least a few
hundred thousand. The problem is the American legal system and all the complexities. If it would be simplified, there would be less of a need for attorneys.
I believe getting divorced should be as easy as getting married if no children or property is involved and the parties agree. You should just have to sign a
paper with a notary and have it filed with the court. Maybe maybe present it in front of a judge. Instead, the American legal system even makes noncontested
divorces rough.

I am against divorces when children are involved. If you liked somebody enough to procreate with them, you should try to make things work. However, when there
are no children or property and two people who have been married extremely briefly or have been separated for years, somebody shouldn’t be forced to stay
married to somebody or go through some crazy legal process. It’s also insane to have to file a complaint to get a divorce and get your freedom back. So many
people are pressured into marriages or enter situations they realize they don’t want to be in, but entered them because maybe they were afraid of time or felt
it was the right thing to do.

Access to justice would improve, at least marginally, if lawyers were allowed to deduct the equivalent in fees for their DONATED hours. Also, court appointment
work should be income tax free, State and Federal.
