conservatorship

my sister has conservatorship over our mom.  the house we live in is in our parent's name, or our mom.  she is incapacitated from suffering a stroke.

my sister could just sell the house & keep the proceeds, & i will be left out in the cold.

Did you provide home care to your mother for two years such that it delayed her institutionalization? If so, consider court approval for a transfer to you under
the caregiver exception; then, on the side, you and your sister could enter into a family agreement to address shared ownership and/or use of the house.

Your sister and the court would have to be on board with this plan.

Just a thought.

thanks.  my sister is the caregiver, & i just help watch our mom, this has
been going on for over seven years.  used to be i would lift her out of the wheelchair & lay her in bed for the night.  Adult Protective Services visited
our home a few times, & said our mom could never be left alone, or she could be
sent to a nursing home.  This has caused my career to suffer, & i got fired once as i could not go to the office everyday.

You potentially satisfy the requirements with respect to your part of the services (overnight supervision) keeping your mother out of the nursing home.  Not
sure how aggressive Michigan Medicaid gets with families and not sure whether they would agree. but it might be worth a shot.

My sister found a man online, & he moved into our house last year.
My sister has bought him a scooter, a smartphone, a spy camera, and lots of other household items.  He is from Iran.  Some of my belongings have gone missing. 
He's been living & hiding in the garage, as our other sister lives with us, & she does not approve, & she has made threats to get our mom removed from our house
over it.

my sister said to me all the stuff in the garage belongs to her too.
99.9% of it is mine, she has one item.  She's stolen lots of my tools, sells
it online, or some old simp shows up at our house to broker a sweet deal.
who paid for the scooter?  bet it was me.

That’s crazy your sister found an Iranian dude. My Lebanese ex has aged terribly. God took him out of my life because he knew I wouldn’t be attracted to him
in a few years. Iranian dudes tend to maybe age better than Arab dudes though. 

Many MENA men peak at 25 and then are hideous past 30. I’m not even somebody who likes young guys, but wow they lose every strange of hair or get weird
baldness patterns. Huge pot bellies and just let themselves go completely. The shisha also dulls the complexion. 

I don’t know Michigan laws, but in Illinois we have transfer on death instruments. If a parent is of sound mind that can do a transfer on death instrument to
leave their house to who they want and this avoids probate.

As for bank accounts, well you want to be sure you are a joint owner. 

I’m sorry your sister may try to sell the house. It’s not right they want to uproot you. Even if your mom is not physically healthy, she just has to be of
sound mind to make sure you are not cut out.

can i be a co-conservator?

the only thing i care about is getting my half of the proceeds from the house.
my name needs to be on the closing docs.
what woke me up is how cavalier she is about stealing my stuff.
  
back in the 90s, my credit cards kept the whole family alive.  Had debt of $70k
by 1997, then some millionaire dude who got rich on stock market gave me $30k, but i was back up there in no time, spend most of my twenties living like a
pauper & paid it off by age 28.  ruined my life, everybody shrugged it off, soon i was just a selfish child again.

I assume your mother is going to the nursing home, and that she's going to need Michigan Medicaid. You and your sister cannot split the house sale proceeds,
that's not how it works. The proceeds go into your mother's account controlled by your sister, as conservator, unless the house is transferred to you first
under the caregiver exception (see my post above).  If you and your sister "split" the house sale proceeds while your mother is alive, your mother will be
penalized under the Medicaid rules and denied coverage for the the duration of the applicable penalty period.
