Lawsuit claims Walmart ignored safety policies ahead of Traverse City stabbing attack

A northern Michigan man who was one of 11 people injured during a July 26 mass stabbing attack at a Traverse City area Walmart is now suing the man who
allegedly stabbed him, along with Walmart, accusing the retailer of negligence.
In a lawsuit filed Tuesday in Grand Traverse Circuit Court, Aaron Boudot, 41, of Traverse City contends Walmart ignored its own safety policies for responding
to suspicious behavior.
Boudot was shopping with his wife, Melinda, and their four children when he was attacked. He was stabbed in his back and arm, severing an artery and nerves,
when he moved to protect his family from attack.
At a virtual news conference Tuesday, David Stechow, one of Boudot's attorneys, said numerous customers at Walmart, including Melinda Boudot, noticed Bradford
Gille behaving strangely before the attack and steered her family away from him.
Stechow and Nicholas Panagakis, another attorney representing Boudot from the firm, Morgan & Morgan, say Gille lingered in the store for more than 30 minutes
ahead of the stabbings. Customers reported seeing his eyes darting around, studying the store's security cameras, pacing around the store without a shopping
cart or basket and noticed his large green backpack.
"The reason that we are all here today is because Walmart has refused to take any responsibility for their negligence," Stechow said.
A Walmart spokeswoman said “the safety of our customers and associates is a top priority. We will review the complaint once served and will respond
appropriately in court.”

Panagakis said Walmart ignored its own safety policies when someone is acting suspiciously —among them a person carrying a large, out-of-season backpack as a
red flag that should prompt action.
"This man loitered in their store with that exact red flag, and Walmart did nothing. They didn't call police; they didn't approach him; they didn't follow their
own safety rules," Panagakis said.
Stechow added some former Walmart employees have told the attorneys they never received training on what to do if they spot suspicious behavior.
"None of that was done. For 33 minutes, all these customers, who are not trained to watch for those types of things, all observed it," he said. "And had Walmart
trained their employees as they they claimed to do — and former employees have told us they did not receive any sort of training in this regard — they would
have known to call the police."

Police arrived at the scene in three minutes of the first 911 call reporting the attack, the lawyers said.
Panagakis said Boudot still does not have the use of his right wrist and hand as a result of the attack. A bystander used his belt as a tourniquet to stop
Boudot's bleeding while they waited for medical attention.
Boudot didn't attend Tuesday's press conference, but in a statement read by the attorneys thanked everyone who helped save his life. As he lay bleeding, he
believed he wouldn't survive, and said goodbye to his family. The couple's children are 13, 11, 8 and 6.
"My goal with this lawsuit is to hold Walmart accountable for my permanent injuries and the trauma my family endured, and to compel Walmart to make the changes
necessary to prevent something like this from happening again," his statement said.
The attorneys claim Walmart's security response was inadequate despite history of violent attacks at other store locations in the U.S. The lawsuit cites fatal
shootings in 2017 in Thornton, Colorado; El Paso, Texas in 2019; and Chesapeake, Virginia in 2022.
The lawsuit seeks at least $25,000 in compensation for the Boudots' injuries and damages.
Panagakis said Gille is named in the lawsuit because the attorneys believe Walmart will try to assign blame entirely to him, and the attorneys claimed Walmart
has not been willing to negotiate with them.
The case includes a civil claim for assault and battery against Gille.
"The law in Michigan allows the defendant, if they want, to blame the attacker in this case," said Panagakis. "And that is what Walmart has made clear to us in
refusing to negotiate in good faith and refusing to attempt to resolve this case in any way whatsoever, because they feel like they can blame the attacker, and
the good people in Traverse County will just give them a pass."
The attorneys noted Gille, who was homeless, had been spotted acting strangely at other nearby businesses, including a Burger King and a Dollar Tree, before he
entered Walmart.
Gille already faces 11 criminal charges of assault with intent to murder and one terrorism count. A Grand Traverse County judge has ordered him held in jail on
a $1 million bond, and separately, declared him mentally unfit to stand trial over the summer.

I have a freaky story on wal mart knives that happened here. There was this girl. She was super young. Still a minor like 15 or 16. She went in a wal mart late
at night. She stole machete and killed an uber driver. NO MOTIVE at all. She didn’t know this guy. There was no attempted rape. No fight before. This wasn’t
some gang initiation ritual. It’s like she was just crazy or possessed.

This is a good case. I think businesses should be responsible. Lord knows police aren't coming to deal with some bro at a wal mart with a knife.
