We may not be as bad as England, but I would say we are arguably worse than some other European countries. Hate crime laws which increase crimes which would otherwise be low level misdemeanors to felonies are ultimately the criminalization of speech. I’m not denying that some people target houses of worship for specific reasons, but what made me realize hate crime laws are problematic was the case of Timothy Trybus in Illinois. He was some drunken old guy in a forest preserve here in Illinois. This Puerto Rican girl told him he needed to leave the gazebo as she rented it out for her bday. She had a PR flag on her shirt and he asked if she was American and a citizen of this country. Dumb sure, but was it anything beyond disorderly conduct? He ended up being convicted of a felony… So yes in countries like Italy there are criminal penalties against speech which on the books seem more severe than what we have here, but a case like Trybus would have never been prosecuted. These laws seem more reserved for those who print straight up lies about somebody or seek to destroy somebody’s reputation. First Amendment is deader than dead anyway. I don’t know what America means in 2025. At the same time, we allow for profit companies under the guise of public information to print personal info about people included addresses which are used by stalkers.
