I wrote my first-ever polemic to an asshole attorney

People who know me know this is very unusual. In fact, this is the first time in 20 years I've written this type of email. Basically, this guy won $5k in
discovery sanctions in a case and I ended up dismissing the case. He has harassed me for 18 months about this measly judgment that he has, and he also harassed
my former colleague Susanna regarding the same thing. I couldn't take it anymore, which is why I wrote the polemic.

I've had a chance to cool off and...I think it's my greatest ever takedown of any attorney, plus one of the best emails I've ever written. Enjoy!

writing in all caps is considered to be the same as yelling

You did good. There are lots of jerks in law who have zero respect for others. They could settle things peacefully, but they want to be hard asses and cause
others unnecessary stress. lol at his surname Capobianco. I know of a guy with that name, but think no relation. Hahaha oh wow I looked this lawyer up. He is
completely bald. Shiny too. His surname means “head white.”

Mediterranean baldness truly suck. I can’t even guess his age, but he likely lost it all early. Some people also maintain the weirdest professional
identities. It’s like they have no personalities outside of work.

Its necessary to start telling people off. You may have done him a favor in the long run because nobody has probably ever had the nerve to call him out. Now he
may change his behavior or think twice in the future.

I made it clear those are my opinions, and I'm not worried at all. Opinion based on disclosed facts is privileged, thankfully.

I did, but he went far beyond normal for collecting money. He sent 12-15 letters and emails threatening us without filing anything with he court. I don't
think this is covered by the litigation privilege.

This guy may be a hired gun. I can’t stand absolute hired guns. Most of the time, they aren’t even advocates for their clients. They just want to bill more
hours and waste the client’s time rather than encouraging settlement. They look out for their own interests not the client. Litigating until the end is almost
never worth it especially in cases where the amount in controversy is only a few thousand dollars. Unless the client has insurance that pays for the litigation
and even then not worth it because insurance rates go up regardless. Also hired guns worry about cases that aren’t even nobel causes or high profile cases.
They just want to steal their client’s money and make opposing counsel’s life a living hell. They forget to have respect for all sides. I can respect
officers of the court more lol. They are just snitches following the rules and I rather deal with nerds like that as opposed to hired guns who try to weaponize
procedure (and yes sometimes the judge’s adhd or old age forgetfulness) and waste years of the lives of their clients and opposing counsel.

*noble lol

anyway hired guns are usually just scumbags or losers with no life outside of work… or maybe they are desperately trying to make partner. either way, its sad
how desensitized some people can become. bullying and harassment doesn’t end in elementary school sadly. many lawyers act like school yard bullies.

If collection fails then they need to go back to the court that has jurisdiction to enforce the settlement. It’s as simple as that. Sometimes the attorney
doesn’t hear from the client again to even get the money to give to the other side.

I used to think labels were BS when they mentioned them in law school, but these archetypes do exist. You really do meet hired guns willing to win at all costs
even when the stakes aren’t high. They will turn simple cases into nightmares. I also find that hired guns are oftentimes former athletes or jocks who fell
from grace, so law was a backup plan.

A female hired gun type is usually a former gunner with no personality aside from a professional identity.

I wouldn’t have sent it. You gained nothing, and he gained a written communication from you with no purpose other than malicious vexatiousness.

If I had sent it, I would’ve given my thesaurus a workout. For starters, you should’ve called him a ‘chickenshit poltroon’ and let dangle an implied
threat of skullfucking.
